H1-B Visa Lawyers in Arapahoe County, CO, Making Your Life Easier

The United States of America welcomes skilled foreign workers in many different ways, one of which is the H1-B visa. The H1-B allows people from other countries to come to America and work in a specialty occupation for a specific employer for up to six years. If you are looking to come to the US on an H1-B visa, or if you are an employer hoping to sponsor someone for this type of visa, you will need the help of an experienced immigration attorney.

Our law firm has been helping individuals and businesses with their immigration needs for years. We understand the complexities involved in H1-B visas and can help ensure that your application is filed correctly and on time. We will also be there to support you throughout the process and help you navigate any challenges that may come up. Get in contact with our experienced family law immigration lawyers today at (720) 922-2988 to learn more about your options.

What is an H1-B Visa?

An H1-B visa is a non-immigrant visa that allows US companies to employ foreign workers in specialty occupations. To qualify for an H1-B visa, the applicant must have a bachelor’s degree or higher in the specific field of work. There are a limited number of H1-B visas available each year, and the demand for these visas often exceeds the supply. As a result, there is a lottery system in place to award visas. Examples of specialty occupations include but are not limited to:

  • Computer Science
  • Engineering
  • Physics
  • Business
  • Economics
  • Accounting
  • Finance
  • Architecture
  • Medicine

H1-B visa holders may be employed in the US for up to six years. After six years, they must either leave the country or obtain another type of visa. However, it is possible to extend the H1-B visa in certain circumstances. For example, if the foreign worker has an approved green card application, they may be eligible for an extension. Additionally, if the foreign worker changes jobs, they may be eligible for a new H1-B visa.

Is the H1-B Visa Process Complicated?

There are a few requirements that must be met in order to qualify for an H1-B visa. First, the position you are applying for must be a “specialty occupation.” This is defined as a job that requires at least a bachelor’s degree or its equivalent in work experience. Some examples of specialty occupations include engineers, scientists, IT professionals, writers, and more.

You will also need to have a job offer from a US employer before you can apply for an H1-B visa. The employer must prove that they are unable to find a qualified American worker to fill the position and that they will pay you the prevailing wage for your occupation.

Finally, you will need to prove that you have the necessary education and/or experience for the job. This can be done with a degree from a US institution, an equivalent foreign degree, or work experience. If you have any questions about whether you meet the requirements for an H1-B visa, our team can help.

Why Should I Hire an H1-B Visa Lawyer?

There are many reasons why you may want to consider hiring an H1-B visa lawyer. The process of obtaining an H1-B visa can be complex and time-consuming. A lawyer can help to ensure that your application is complete and accurate and that you meet all of the eligibility requirements.

A lawyer can also provide valuable assistance if your application for an H1-B visa is denied. Denial can be devastating, especially if you have already made plans to relocate to the United States. A lawyer can help you to understand the reasons for the denial and to explore your options for appealing the decision or applying for a different type of visa.
