NIW Lawyers in Arapahoe County, CO, Making Sense Out of Your Situation

No one wants to think that they need an attorney, but when you find yourself in a situation where you might need one, it is important to know your options. McGuire Law has NIW lawyers in Arapahoe County that can help you make sense of your situation and help you plan your next steps. The National Interest Waiver (NIW) is a waiver available to certain foreign nationals who are seeking permanent residency through employment-based immigration. This waiver allows foreign nationals to bypass the usual requirement of having a job offer from a U.S. employer and instead self-petition for permanent residency.

To qualify for an NIW, foreign nationals must demonstrate that their abilities are so extraordinary that their continued presence in the United States would be in the national interest of the United States. The standards for qualifying for an NIW are high, and the process can be complex and confusing. That is why it is important to have an experienced attorney on your side who can help you navigate the process and give you the best chance of success.

At McGuire Law, we have extensive experience handling NIW cases, and we know what it takes to succeed. We will work tirelessly on your behalf to build a strong case and present it in the most favorable light possible. Get in contact with our experienced family law immigration lawyers today at (720) 802-2705 to learn more about your options.

What is an NIW?

An NIW, or national interest waiver, is a type of visa that allows highly skilled individuals to live and work in the United States. Individuals who qualify for an NIW are those who have extraordinary ability in their field or who are able to contribute to the national interest of the United States.

To qualify for an NIW, an individual must first obtain a job offer from a U.S. employer. The individual must then demonstrate that they meet one of the following criteria:

-The individual has extraordinary ability in their field

-The individual’s work will substantially benefit the United States

-The national interest of the United States would be adversely affected if the individual was not allowed to live and work in the country

If an individual is able to demonstrate that they meet one of the above criteria, they may be eligible for an NIW. Once an individual has been granted an NIW, they will be able to live and work in the United States. Our skilled team can work with you to determine if you qualify for an NIW and help you through the application process.

What is the NIW Application Process?

The process of applying for a National Interest Waiver is similar to other employment-based green card categories. The first step is to have a prospective employer file a petition on your behalf with U.S. Citizenship and Immigration Services (USCIS).

Once the petition is approved, you will need to go through the immigrant visa process. This includes an interview at a U.S. consulate or embassy, where you will be asked questions about your eligibility for a green card.

If you are approved for a National Interest Waiver, you will be granted a green card and will be able to live and work in the United States permanently.

What Should I Know About the NIW?

There are a few things to keep in mind if you are considering applying for a National Interest Waiver. First, you will need to demonstrate that you have exceptional ability in your field. This means that you must be able to show that you are one of the best in your field.

Second, you will need to show that granting you a green card would be in the national interest of the United States. This can be difficult to prove, but it is important to remember that USCIS will consider the economic impact of your work as well as the social and cultural contributions you will make to the United States.

If you think you may be eligible for a National Interest Waiver, it is important to consult with an experienced immigration attorney who can help you navigate the complex application process.
